1. Acceptance of Terms
By accessing or using HoodServe (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform. These Terms apply to all visitors, subscribers, employees added to subscriber accounts, and anyone who interacts with a website or form powered by the Platform.
2. What HoodServe Is
HoodServe is a subscription-based software platform (CRM) that provides independent service businesses — including but not limited to cleaning companies, lawn care providers, handyman services, and personal care businesses — with tools to manage their operations. These tools include:
- Booking and scheduling management
- Client relationship management (CRM) and lead tracking
- Invoicing, estimates, and online payment collection (via Stripe)
- Team management, job checklists, and payroll tracking
- A website builder with SEO tools, booking forms, and blog functionality
- A branded client portal for each subscriber's customers
HoodServe is not a service provider, staffing agency, or marketplace. We do not employ, supervise, refer, or dispatch workers. We do not take commissions on jobs. We do not sell leads. We provide software tools that businesses use to run their own operations.
3. Accounts & Registration
- You must be at least 18 years old to create an account.
- You must provide accurate, current, and complete information during registration and keep it updated.
- Accounts are registered with an email address and password. We do not offer social login.
- All public-facing forms on HoodServe are protected by Cloudflare Turnstile to prevent spam and bot submissions.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Notify us immediately of any unauthorized use at support@hoodserve.com.
- We reserve the right to refuse service or terminate accounts that violate these Terms.
4. Subscriber Responsibilities
"Subscribers" are businesses or individuals who pay for a HoodServe subscription. As a subscriber, you agree to:
- Use the Platform only for lawful business purposes.
- Ensure all information you enter into the Platform — including client data, service listings, pricing, and business details — is accurate and not misleading.
- Comply with all applicable laws regarding the services you offer through your HoodServe-powered website, including licensing, insurance, and consumer protection laws in your jurisdiction.
- Obtain any required consents before importing or uploading client contact information into the Platform.
- Manage your team members' access responsibly. You are accountable for actions taken by any team member added to your account.
- Not use the Platform to send unsolicited communications (spam) to clients or leads.
5. End Users of Subscriber Websites
If you are a customer or visitor interacting with a website, booking form, or client portal powered by HoodServe on behalf of a subscribing business:
- Your primary relationship is with the subscribing business, not with HoodServe.
- HoodServe provides the technology. The subscribing business is responsible for delivering the services you book, fulfilling estimates, and honoring their own policies.
- HoodServe is not a party to any agreement between you and the subscribing business and is not liable for the quality, safety, or delivery of any services.
- Payment disputes for services should be directed to the subscribing business first. If you used Stripe to pay, you may also contact Stripe support.
6. Prohibited Conduct
All users agree not to:
- Use the Platform for any unlawful purpose or to facilitate illegal activity.
- Submit false, misleading, defamatory, or fraudulent information.
- Attempt to gain unauthorized access to any part of the Platform, its servers, or other users' accounts.
- Use automated tools (bots, scrapers, crawlers) to extract data from the Platform without written permission.
- Reverse engineer, decompile, or attempt to derive the source code of the Platform.
- Resell or sublicense access to the Platform without written authorization from HoodServe.
- Upload or transmit malware, viruses, or any code designed to disrupt or damage the Platform.
- Impersonate any person, business, or entity.
7. Subscription & Payments
- HoodServe charges a recurring subscription fee based on the plan you select. All fees are displayed in U.S. dollars.
- Subscriptions are billed monthly or annually depending on your selected billing cycle. Annual plans are discounted approximately 17% compared to monthly.
- A free trial period is offered on select plans. No credit card is required to start a trial. After the trial, you must subscribe to continue using the Platform.
- Subscription payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
- You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for unused time on monthly plans.
- If a payment fails, we will notify you and provide a grace period to update your payment method before suspending access.
- We reserve the right to change subscription pricing with at least 30 days' notice to active subscribers.
- HoodServe does not take commissions on any jobs, bookings, or payments processed between subscribers and their clients. Your revenue is yours.
8. Intellectual Property
The Platform, including its design, code, features, and content created by HoodServe, is and remains the exclusive property of HoodServe and its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written consent.
Content you create within the Platform — such as your business listings, service descriptions, blog posts, and client data — remains your property. You grant HoodServe a limited license to store, display, and process that content solely to provide the Platform services to you.
HoodServe's name, logo, and brand assets may not be used without prior written permission.
9. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. HOODSERVE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT GUARANTEE THAT THE PLATFORM WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS OR THAT IT WILL BE AVAILABLE AT ALL TIMES.
HOODSERVE IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, LEGALITY, OR DELIVERY OF SERVICES PERFORMED BY ANY SUBSCRIBING BUSINESS OR THEIR EMPLOYEES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOODSERVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF REVENUE, DATA, OR BUSINESS OPPORTUNITIES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL HOODSERVE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL SUBSCRIPTION FEES YOU PAID TO HOODSERVE IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless HoodServe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any services you provide to your clients through the Platform.
12. Dispute Resolution & Arbitration
Informal Resolution First. Before initiating any formal proceeding, you agree to contact us at legal@hoodserve.com and give us 30 days to attempt to resolve the dispute informally.
Binding Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), not in court, except for claims that qualify for small claims court.
Class Action Waiver. You agree to resolve disputes only on an individual basis. You waive any right to bring or participate in a class action or representative proceeding.
Opt-Out. You may opt out of arbitration by sending written notice to legal@hoodserve.com within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you are opting out.
13. Termination
You may cancel your subscription at any time via your account dashboard.
We may suspend or terminate your account immediately if you materially breach these Terms, engage in fraudulent activity, or pose a risk to the security or integrity of the Platform. We will attempt to notify you unless doing so would cause harm or is prohibited by law.
Upon termination, your right to access the Platform ends. You may request an export of your data within 30 days of termination. Sections 8, 9, 10, 11, 12, and 14 survive termination.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. To the extent arbitration does not apply, you consent to exclusive jurisdiction in the courts of Delaware.
15. Changes to Terms
We may update these Terms from time to time. For material changes, we will notify active subscribers by email at least 30 days before the change takes effect. The updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Platform after the effective date constitutes your acceptance.
